It`s time to talk about one very problematic topic within Islam : marriage and weddings. Many Islamic scholars argue even until now about details in the Islamic law of marriage. Where is the truth? What we can read in the ancient hadith is :
Narrated 'Ursa:
that he asked `Aisha about the Statement of Allah: 'If you fear that you shall not be able to deal justly with the orphan girls, then marry (other) women of your choice, two or three or four; but if you fear that you shall not be able to deal justly (with them), then only one, or (the captives) that your right hands possess. That will be nearer to prevent you from doing injustice.' (4.3) `Aisha said, "O my nephew! (This Verse has been revealed in connection with) an orphan girl under the guardianship of her guardian who is attracted by her wealth and beauty and intends to marry her with a Mahr less than what other women of her standard deserve. So they (such guardians) have been forbidden to marry them unless they do justice to them and give them their full Mahr, and they are ordered to marry other women instead of them."
Leaving aside what was told here about "captivities" and slaves women (that could be another topic), we can see the hadith can be interpreted in many ways, because it is about free choice of the man. Its told : "if you fear that you..." when a man would fear about that?When the mind is stronger than the feeling! In which cases that happen in practice? There is very little and few cases ,just because "dealing justly is question of more or less personal perception! So we can come the the conclusion, that something is missing in this hadith and specially : to draw the limits and exact points in man behavior to woman. having a woman in many of hadiths is very equal to possessing sheep or jewelry or any special object of desire, which can be sold by money.It`s easy to imagine the justice in that kind of dealing, according to the epoch and the time when its written, and circumstances. (Arab tribes in this period were not settled or stable, but moving and taking lands, often as soldiers, so thats one point, which makes Mohammed to control his own society and tribes). Marrying an orphan girl could be viewed as a help, but only in this particular time! Now that could be accepted as violent, as well as the choice of the orphan girl is never mentioned. Another arguable point. The status of women in society is not only stamped and determined by men and Islamic laws, but by her own attitude and view to herself. She look to herself as always down-standing to man, some kind of primitive mind, which can`t help in her development as a free person. The freedom is not supposed to be in an object, simply because he can`t move by himself! In this direction we should think about woman in era of hadith. (what about now?)
